But even though it is a synthesized derivative of THC, it can be derived from the hemp plant. But we’ll leave that explanation for another article. This puts the synthetic cannabinoid in a grey area when it comes to legality and regulations.
Because all hemp derivatives are usually considered federally regulated (as long as they contain no more than 0.3% D9 THC), then THC-O Acetate probably falls under that same category. But our experience with other THC derivatives like D8 and D10 THCs has made us a bit wary on the subject of legality.
So we’ve decided to put a stop to that ambiguity and tried to tackle the topic from a perspective that makes sense.
To your potential surprise, THC-O has not yet been declared an illegal substance on a federal level. So the belief that it falls under the 2018 Farm Bill remains true.
In other words:
If you thought that because it’s ultimately derived from hemp then it is legal is actually a true statement. But to that same fact, we say, the hemp plant itself falls under that category for sure and we still have trouble with it in certain states. But that’s something that the country and regulations will ultimately catch up to.
That said:
Is THC-O Acetate federally legal? The answer is, likely, but not certainly. As we explained before, other products like Delta 8, Delta 10, and CBD are also derived from hemp and comply with the 2018 Farm Bill wording, nevertheless, confusion seems to reign supreme.
